Code of Conduct (the “Code of Conduct”)

This Code of Conduct applies to all users (the “Users”) of the platform (the “Ev Concierge”) and supplements the terms and conditions accepted during registration and the privacy policy contained within the Ev Concierge (collectively, the “Terms of Use”). It is understood that in the event of any conflict between this Code of Conduct and the Terms of Use, the latter shall take precedence.

1. Purpose

This Code of Conduct provides guidance on the conduct to be adhered to and/or avoided while utilizing the Ev Concierge to enhance its use and safeguard Users during its utilization. It is understood that Users commit to abiding by this Code of Conduct and the Terms of Use while using the Platform.

2. Registration on the Ev Concierge

To utilize the Ev Concierge, Users must register through a designated form and concurrently create their own account (the “User Account”).

If the user is under 14 years of age, registration on the Ev Concierge must be conducted by the legal guardian, who must adhere to the rules defined in this Code of Conduct and instruct the minor accordingly. If the minor is 14 years of age or older - or the equivalent minimum age in the relevant jurisdiction - they may proceed, pursuant to and for the purposes of Article 2 quinquies of Legislative Decree 196/2003 (as amended by Legislative Decree 101/2018), to registration and any expression of consent to processing, while also complying with the provisions of this Code of Conduct, like other Users. In the event of any unlawful conduct and/or improper use of the Ev Concierge by minors under the age of 14, or the equivalent minimum age in the relevant jurisdiction, the parent or legal guardian declared during the registration process of the minor's User Account shall be held responsible.

It is understood that, if there is suspicion that the User Account has been illicitly opened by a minor in violation of this Code of Conduct, we may request verification of the parent's identity by requesting the sharing of an identity document.

3. Limits on the Use of the Ev Concierge

In using the Ev Concierge, Users acknowledge and guarantee freedom of expression, while reserving the right to limit certain content or behaviours to respect and safeguard other Users in accordance with this article.

To utilize the Ev Concierge, Users undertake to comply with the following limitations:

Not to use fake email addresses and/or false identities with the intention to mislead, confuse, or deceive third parties, and not to create more than one account or shared accounts.

Not to use third-party business names and/or logos that may mislead Users, and in any case, not to violate intellectual property and/or copyright laws.

Not to disclose on the Ev Concierge, in any way, private, confidential, and personal information of third parties without specific authorization, including but not limited to credit card numbers, postal addresses, and social security numbers/ID numbers.

Not to publish specific threats of violence against third parties or content that may affect public safety, including but not limited to terrorism-related activities.

Not to promote acts of virtual or real violence through content published on the Ev Concierge.

Not to use the Ev Concierge for unlawful purposes or to support illegal activities contrary to international laws and the laws of the Users' respective jurisdictions.

Not to engage in or encourage bullying, harassment, and/or discrimination, including sending unwanted messages or requests to other Users.

Not to share pornographic and/or child pornographic content or any other sexually explicit content that may offend other Users or be offensive or discriminatory in any way.

Not to engage in conduct that may compromise the privacy and/or security of the Ev Concierge and its Users. Particularly, if personal data of third parties is shared, Users must ensure they have obtained any necessary consents from the data subjects and complied with relevant regulations (EU Regulation 2016/679 and Legislative Decree 196/2003, as amended by Legislative Decree 101/2018).

Not to share content for commercial purposes without prior consent.

Not to buy or sell registered User names on the Ev Concierge.

Not to publish or redirect to websites aimed at stealing personal, sensitive, and/or confidential information of other Users, or websites containing computer viruses.

Not to engage in spamming activities, defined as the repeated sending of unwanted and irrelevant content to the Ev Concierge. Criteria for identifying spam include a high number of well-founded complaints from Users, suspicion of activity from two different accounts belonging to the same person, publication of numerous irrelevant contents, creation of fake contents aimed at redirecting Users to other accounts or websites, repeated publication of others' information as one's own, and creation of multiple accounts to fraudulently increase visibility. We reserve the right to investigate Users' accounts suspected of violating these restrictions and may suspend such accounts pending clarification.

In the event of violations by Users of one or more of the aforementioned limitations, we reserve the right to intervene by removing and/or moderating the contents published by them on the Ev Concierge, and to consider suspending or permanently deleting the account without prior notice. If it is found that an account has been created to replace another previously suspended account, we reserve the right to permanently suspend both accounts.

Users who believe that other Users have posted harmful, offensive, or otherwise violating content on the Ev Concierge may report such violations by contacting customer service at [email protected]. We will undertake an appropriate investigation based on the report to take necessary measures. Reporting does not guarantee the removal of the reported content. If the reported content is found to be harmful, we will proceed to remove it from the Ev Concierge.

To ensure Users' rights, we maintain complete and unlimited editorial control over all content.

4. Links to Other Websites

The Ev Concierge contains links and connections to third-party websites. It is understood that we do not control, manage, and are not liable in any way to any natural or legal person for the content, availability, and accuracy of such websites, or for compliance with any data protection laws or intellectual property rights provisions.

5. Content Authorizations

During the use of the Ev Concierge, Users grant us all necessary authorizations on the published content. When Users share, post, or upload content covered by intellectual property rights on the Ev Concierge, they grant us a royalty-free, transferable, sublicensable, and worldwide authorization to store, use, distribute, modify, perform, copy, publicly execute or display, translate, and create derivative works of their content, in accordance with the Terms and Conditions.

The authorizations granted herein shall cease to exist once the content on the Ev Concierge has been deleted by Users and/or by the Ev Concierge itself. Users may delete published content and their accounts at any time through the privacy management section on the Ev Concierge, in accordance with the Privacy Policy.

The Code of Conduct may be amended from time to time, and any material changes shall be promptly notified to Users.
